We take a different approach to talking about cases than many attorneys. Remember, whether you are working against an adjuster or a defense attorney you are at a distinct disadvantage: Both of them are professionals who do nothing but personal injury cases or workers’ comp claims. They know the law – and the loopholes. They know exactly what they must do – and what they can get away with. So make your decision to hire an attorney wisely.
That brings up an important issue. Insurance adjusters, whether they are workers’ compensation adjusters or personal injury adjusters, keep records on what attorneys do. The ability to demand the respect of an adjuster is directly related to an attorney’s proven capacity to win cases in court. If an attorney tells you they don’t have to go to a jury trial often or don’t have to appear before the workers’ compensation board regularly, because insurance adjusters always settle cases with them, you should run, not walk, out of the office. It simply isn’t true. Adjusters only pay top dollar settlements to injured people who have attorneys with a demonstrated record of taking tough case to trial or hearings.
